I'm pretty sure Shaver replied that he wasn't drunk when the cops asked him, but he was.

Maybe they thought he wasn't drunk, maybe if they knew that he was, they would've legislated for his erratic responses to their demands.

And in the police's defense, this did come after the Las Vegas shootings where Paddock fired from a 32nd story window, so this would've heightened tensions a lot.

I still think this could've been avoided. I would hold the sergeant just as responsible as the nerd who fired the shots.
