While the crux of the defense argument seems to be John Rubeo is untrustworthy because he's a gangster. Which is pretty asinine when you consider that turncoat mobsters have been a fixture of mafia case prosecutions for over 40 years.
There have been several books written over the years featuring guys (Previte) talking repeatedly about how Merlino doesn't randomly get involved with other mob guys, let alone close to them, unless there is a scam in the offing.
