He didnt really say...it was a recent pic of Joey at Rao's. It was towards the sentiment about the different pictures he posted on his insta....

Merlino frequently interacts with his “followers” on Instagram and allows his “fans” to take pictures with him to post on their respective social media accounts.

He just spoke of the pictures that were posted on his IG. Not that they just happened. Maybe Joey posted it as a flash back photo and Scott just referenced the fact he posted a photo out front of Rao's?
