Provided Merlino loses the appeal, he will most certainly be in jail throughout a big portion Nicodemo's trial. And, if Nicodemo's 2nd trial moves at the same pace as the 1st, he may still be locked up after Nicodemos verdict is read.

The first trial lasted such a short time for a very good reason. Because it's a garden variety homicide. No RICO, no additional charges. I can't see the retrial taking much longer.
