A Superior Court judge is expected to decide next month whether Raynald Desjardins should be freed on bail while charged with the first-degree murder in the death of Salvatore Montagna.

The last person to testify at the hearing was 59-year-old Desjardins. His ex-wife, Christine Lapierre, and daughter, Vanessa Desjardins, also testified. After closing arguments were made, by defence lawyer Marc Labelle and prosecutor Eric Côté, David announced he will deliver his decision at a later date, likely in May. Montagna was shot to death on Nov. 24, 2011, in Île Vaudry, an island just east of Montreal.

While Desjardins was testifying Tuesday at the Gouin courthouse, his son Mathieu, 24, was at the St-Jérôme courthouse where he settled a criminal case brought against him in March 2012. The younger Desjardins was charged with two counts of extortion following an investigation by the Sûreté du Québec. On Tuesday, the 24-year-old was acquitted after agreeing to follow a series of conditions set in a peace bond, commonly referred to in Canadian courts as an 810, a reference to the numbered section of the Criminal Code that touches on such agreements.

With the case still pending in May last year, Mathieu Desjardins agreed to not carry any firearms while he was charged. But in June, he was charged with being in possession of a prohibited or restricted weapon after being arrested by the Montreal police. The firearm possession charge is still pending, and the next date in that case is set for October at the Montreal courthouse....
