Graziano was never the official consigliere and if you look at his indictments he is listed as a capo
He actually was the consigliere and was indicted as such back in 2002 on two cases in New York and Florida. When he came out of prison his rank had changed to captain and that's what he was indicted as most recently.
Why the rank change is anybody's guess. In my opinion, it probably had something to do with the boss and underboss in the administration he was a part of flipping. Of course, he didn't flip himself and still carried a significant rank as captain, though no longer part of a new administration. But that's apparently changed now with the problems with his former son-in-law and the TV show.
