i would have thought that they would need permission from there families. they would get a certain amount of money for there namesake.

Well that all depends. For them to use the full name, i.e. Jimmy Burke, then yes. But if they were basing a character on a real life guy, then probably not.
If winners never lose, well, then a loser sure can sing the blues.

Well the original SCARFACE movie(not the remake we all dig) by Howard Hawkes in 1932 was based unofficially on Al Capone(among his nicknames was "Scarface" because of his noticeble scar) but they danced around having to do get/buy Capone's life story by making a fictional character BASED on the real deal.
Now, some mob flicks are based on novels like Nicholas Pileggi's CASINO and WISEGUYS(which became GOODFELLAS) or DONNIE BRASCO which includes these real mobsters with their names intact.

Yes they are. But the movie makers changed a few names to get around the legalities/royalties stuff. Either that or they were afraid of retribution if they used the real names! Jimmy Conway, Paulie Cicero for starters.
