The banning of the American corporation of the Hells Angels Motorcycle Club in the Netherlands is impossible. The lawyers of this corporation argue this Thursday in the court in Utrecht. The Public Prosecution Service (OM) wants to ban both the national and the international branch of the motorcycle club in the Netherlands.
"There are no members in the corporation, it is a separate entity that protects the international property right," says the lawyer. "If the court were to forbid the corporation, that could have the strange consequence that third parties could infringe the logo, without the corporation being able to do anything about it." People could then copy the registered Hells Angels logo, a skull with wings, but the corporation can not act against it, because it is forbidden here.
Attorney Geert-Jan Knoops argued on Wednesday that the majority of the members of the Hells Angels are "normal" citizens with a permanent job. According to him, their rights would be violated if the entire club is banned, as justice wants.
Knoops responded with his plea to the earlier argument of the Public Prosecutor (OM) that the continuation of both the Hells Angels in the Netherlands and the foreign corporation would constitute a danger to public order.
