FORMER Philly mob boss Joey Merlino will have time to perfect his "Gnocchi Mamma Rita" and "Veal South Philly" at his new Boca Raton, Fla., restaurant, Merlino's, and can enjoy his holidays in the Sunshine State.

Although a federal judge in Philadelphia has denied Merlino's request to postpone his four-month prison sentence pending his appeal to the Third Circuit, the judge allowed Merlino to push back the day when he must report to prison.

U.S. District Judge R. Barclay Surrick, in an order signed Friday and made public yesterday, said Merlino won't have to start his prison sentence next week, as originally ordered, but must begin it Jan. 5.

Surrick last month ruled that Merlino had violated the terms of his supervised release on a 2001 racketeering conviction by meeting with a member of the Philly crime family, John "Johnny Chang" Ciancaglini, in a Boca Raton cigar bar in June.

Merlino's lawyers, who appealed the judge's findings, claimed that the meeting was a "chance, casual encounter" that didn't violate probation.

It is not clear if the Third Circuit will rule on Merlino's appeal before or after Jan. 5. Assistant U.S. Attorney David Troyer yesterday said it could be months before the appellate court rules.

Surrick, in a court order, said the postponement of Merlino's prison-start date "will give the Third Circuit the opportunity to review [the appeal] before [Merlino] is required to report."

But in a separate memorandum, Surrick wrote that "there is little likelihood of success in [Merlino's] appeal."

Provided Merlino loses the appeal, he will most certainly be in jail throughout a big portion Nicodemo's trial. And, if Nicodemo's 2nd trial moves at the same pace as the 1st, he may still be locked up after Nicodemos verdict is read.

The first trial lasted such a short time for a very good reason. Because it's a garden variety homicide. No RICO, no additional charges. I can't see the retrial taking much longer.

Overheard someone saying that Merlino and his boys were causing a ruckus in Chickie & Petes a few weeks ago. Apparently trying to shake it down.

If true, it would appear to be "business as usual" for LCN; an "garden variety" extrortion (nod to PB for the expression ). Except, Chickie and Petes finances have/were/are under watch because they were strong arming their employees.

So is he gonna be locked up for 4 months, 120 days, exactly? Not that it really matters but, things will remain the way the they are. I'm sure there will be lots of speculation on what people think is going on.

But as far as the rant goes, in eight years on the boards I've never once posted anything incriminating about anyone alive and on the street. Not once. I post about ancient history and I have a reason for every post I make on these boards.

Do you know how many times I've steered threads in a certain direction to protect people? Too many times to count. So whether this guy is from Philly (because he mentioned Nicky Whip), or from the Bronx, or actually from France, he should give that some thought .

Now get it back on track. The truth is, I never really posted about Philly. Because it's true that I DON'T know anything about that town other than what people who I respect tell me. The only reason it got my attention these past few months is because of the Merlino-Boca Raton angle, and that's only because I live close by in the winter. Our condo in Delray is a ten minute drive from that new restaurant.

And speaking of the restaurant, the timing kinda sucks for Joey because he's going to miss "the season." Even if you're not a semi-retiree, like me, you know that the busiest time of year for South Florida is January through May. That's "snowbird" time. And coincidentally, those are the four months that he'll be inside. But I don't blame him, because I'd rather give up the winter in Florida than be inside for Christmas.

Yea but PB let's be honest: SS numbers, Licenses, Addresses??...Credibility went out the door with those claims.

1. Clearly the guy is not from France. If you note some of our posters from other countries (Not our British guys) when the language gets to past participles and adjective placements sometimes the wording won't flow as smoothly but you can still understand what they are saying. I'm not taking anything away from those guys because they all hold valuable information,and I respect what they have to say. But let's face it, bigcapuccinos post flowed way too easy for a guy from France.

Given the proximity in which he replied, I'm inclined to believe that NickyWhip's post holds some serious weight to it and the Philly boys didn't get much sleep last night thinking that word about that alleged extortion would have never gotten out, yet now its on a public message board! . I really dont get why people glorify Merlino. Right now for some reason he has the most internet fanboys. It sucks reading all these comments that glorify this asshole. One other thing. Anyone from philly who thinks these guys in philly have so much power and are respected so much I got one thing to say. A few years ago one of the younger Changalini's who I went to Roman with got locked up for raping a girl in wildwood nj during the summer. When he got locked up HE CONVERTED TO MUSLIM for protection because he couldnt stand on his own two feet in lockup. You think that would happen in NYC or Italy? LMAO. Heres one of the most " powerful" families in the philly mob and their nephew is converting to ISlam for fucking protection. Wearing the beanie and dress and all. I know this because a few of my buddies from SP told me this and they used to hang with him and they grew up with him. I got no reason to doubt it.
