What if there was another body/shooter in the car who was dropped off - there is no way they could run plates and beat Nicodemo home - it's a mile away from his house

I brought this up before but when that home invasion in Staten Island went bad and they killed that women Chris Paciello never even got out of the car,was never in the house yet still got charged like the guys that did the shooting.Just the fact that Nicodemo was there makes him guilty,I don't think it matters who the attorney is.

It's called the Felony Murder Statute, 22. And you're absolutely right. It varies from state to state, but the gist of it reads that if someone is killed during the commission of a crime, everyone involved in said crime, up and down the line, is just as guilty as the shooter.

That's the charge that that little punk Lillo Brancato was facing a few years ago when his pal killed that Bronx cop during a drug induced botched robbery. He beat it, though. But the cases are apples and oranges. They had the shooter in the Brancato case, and if I remember correctly he got something like twenty five to life.

They're trying to keep the id's of the witnesses from coming out. You know Nicodemo is going to try to get to them and convince them it's not in their best interest to testify.

Make sure that you try Tramonti in Delray Beach. Best Italian restaurant in Palm Beach County if you ask me. Only been there a couple years but they're owned by the same family as Angelo's of Mulberry Street. And they've been there for over a hundred years.

I don't know why they even bothered with the motion after the other guys were bound over. It stands to reason that, guilty or not guilty, if the subordinates in a criminal enterprise are denied bail, it's a foregone conclusion that the alleged boss is going to be denied also.

But I guess the defense has to go through the motions to inspire confidence in their clients. Plus, it allows them to pad the bill. Friggin' defense lawyers .
