You can't really compare Peter Schebetta (whose entire character was poorly written) to Nicodemo's situation. Peter was trying to kill someone much stronger than him (and didn't even bring a weapon) while Nicodemo is just looking to avoid trouble.
They have another person of interest in this hit they don't think he acted on his own
