Even so-called originalists disagree about how far the 9th amendment should go. The Founders left it vague on purpose.
Bork referred to the 9th amendment as an "inkblot". These unenumerated rights have to be ethical and accepted by society. You can't have people claiming rights out of thin air (ex. I have a right to a million bucks and a mercedes!!).
Whether enumerated or unenumerated, rights extend to those who can't speak for themselves...namely the unborn.
