I find it interesting how all the "conservatives" who favor judicial restraint now favor judicial activism when their ox is gored.

This judge is a notorious right winger, and they chose the forum so he would decide. THe 11th Cir. may well just forward this to the Supremes. If they don't my guess is they will affirm the part that strikes down the individual mandate and reverse the part that strikes down the entire law.

The 9th Circuit is more lberal, and they'll probably vote to uphold the law.

As for the Supremes, two words: Anthony Kennedy.
