"They", here, say to keep our gas heat at 68 in the Fall/Winter... I'm like, um... noooooooo, tried that (for like an hour), and then tried 70. Still no good. Trying 71 now. whistle lol

But don't get me wrong... I HATE "HOT" houses during the winter! I'm a sweater, and would rather not have to sweat during the cold months, thanks! lol

But 85 ???????? eek panic Is there a hotel nearby? wink

Yeah 85 is too hot! Anything more than 70 is too warm for me. I like to keep the heater around 68-70 during the winter.

I meant at maybe 85 I'd turn my air on, not that I set the thermostat to 85. In the winter I try to keep it at 72-75 unless I'm absolutely freezing. Whoever installed thermostat set it for an "average" of 62 and it automatically drops down to 62 during the day unless I constantly override it which I do. I don't know how to change it permanently where I can control it. I figure a man must of installed it if he thinks 62 is just right. rolleyes wink

It's in the low 50s high 40s here. My winter coat is in the closet and I don't plan on wearing it until December. I won't put it back in the closet until the end of April...just to be sure I don't jinx the weather again.

Some things I've learned from switching past the news and sports channels:

I don't exactly know who she is, or what her claim to fame is, but that Kim Kardashian is one of the most beautiful women I've seen in my life.

I saw an episode of "All in the Family" the other day where Archie's hated cousin died in the house, and he was bombarded with well wishers while trying to raise money among relatives and negotiate with the undertaker. You don't see performances like Carroll O'Connor's anymore.

I've also watched rebroadcasts of the 1969 and 1978 world series, and one would think that 40 years passed between those 9 years. In '69 fans still wore ties and jackets to the games, and Curt Gowdy/Lindsey Nelson announced only the happenings on the field. In '78 dress was casual and Howard Cosell dominated the broadcast by gushing and praising practically every player in the game.

I get hooked on those infomercials that have that stocky red headed lady making treats in her electric sandwich maker for the tall goofy guy. He barely takes a nibble of her food and his eyes roll back in his head as he proclaims the 90 second snack made from Bisquick, cheese and leftover chicken is the greatest thing he's ever eaten.

There are far more commercials on tv than there were 25 years ago.

Really? There is not one infomercial that I watch. There are way way too many on tv. That's not to say that some of the stuff doesn't look appealing. Don't know if there's an infomercial on it, but it's a tv commercial (and will fit in perfectly with the above conversation on the weather), I recently got one of those snugglie's grin I just like to be warm. grin

I like the shapewear infomercials. I think it's hilarious the way women are obsessed with artifically trying to achieve a certain body shape. Why do ya'll put yourselves through that torture?

No I haven't. I've passed the shamwow commercial while changing channels (and may even buy one some day), the other two I never heard of. I NEVER sit and watch any of them.

Plus, Bed Bath & Beyond has a section of tv infomercial stuff in their store that I'll browse from time to time.

The girls got me the ShamWOW for Christmas last year. And the Magic Bullet (except I believe it's spelled differently) is great for cooking. I use it mostly as a mixer, and sometimes as a chopper. You have to check it out. Now they came out with one that has a juicer. I've never wanted to juice anything, but man, now I do!!

I'm also one of those people that tastes the samples in Costco and then walks, trancelike, right to the freezer case to buy whatever it is that I just ate. lol

Was at the grocery store last night and ran into Mighty Putty and thought that'd be perfect to repair some of the brickface in the kitchen. Brought it home to discover the package of 3 bottles only contained 2 so I gotta exchange it. rolleyes I hate when I get ripped off and have to go back to be (even nonverbally) suspected of stealing part of the product. So, do you recommend the sham wow? It's not that I never heard of some of these items. It's hard to miss some. On weekends many times every channel has nothing but infomercials. rolleyes

Anyway what about that little clip thingy that you clip to your bra so you can wear any style dresses without bra straps showing? It seems so convenient, but I have a feeling it's a struggle to adjust.

The bra thing doesn't interest me, although I did buy Smooth Away and Mighty MendIt. I also wanted to buy my daughter a BumpIt for her hair, and she just laughed.

The ShamWOW is great for certain things. I hand wash sweaters, but they take forever to dry. I roll the sweater up in the ShamWOW, just like in the infomercial, and it really does take a ton of water out. I don't know if it works any better than any other chamois, but it does work well.

We bought some Mighty Putty. It does work very well.

I don't like mandates to buy insurance. I think they are unconstitutional under 10th amendment. I would like to see that argument settled in the courts.

That said under a purely wonkish view, I would have just preferred opening up Medicare +10% cost to everyone.

The problem with the ninth and tenth amendment is that the list of state's and individual rights that one can infer could be endless. Neither amendment can be satisfactorily reconciled with the Constitution's Elastic Clause.

Both amendments were included as a sop to those who who believed that any listing of rights would only constrain the federal government's limiting of those rights and to further elaborate on the principle of federalism.

Absolutely. But I don't think that requiring individuals to purchase something they don't want to purchase falls under Congress' power to tax or spend. It's not really even eminent domain. I can't off the top of my head recall a case in which one group of private individuals was required by law to purchase a product sold by another group of private individuals on an ongoing basis. This is unprecedented.

Why should the federal government be able to compel anyone to do this?

Well, car insurance comes to mind.

Neither the Congressional power to tax and spend or eminent domain are germane to health insurance requirements are contained in the recently passed House bill. The constitutional provisions that are germane are those of Article I, Section 8 "provide for ... general welfare" and its last paragraph, the Elastic Clause.

Car insurance is mandated at the state level, though not federal.
And car insurance is only required if you indeed own and register a car and intend to drive it. If you decide not to drive or indeed don't own a car, no one is going to fine you for not purchasing auto insurance. You can "opt out".

On the other hand, if this bill became law, merely existing would require you to purchase health insurance. That's a different kettle of fish. You can't opt out.

I don't believe that the "Necessary and Proper" clause gives Congress unlimited power to make law. Much the opposite. If the proposed law falls out of Congress' authority under the Constitution, it has no right to pass it and it should be found unconstitutional.

IMO.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

I think that's enough to at least have an argument against mandates.
I would like to see this go to court (or a few other cases) so that there can be some more clarity gained about what the 10th Amendment means.

The Supreme Court has, more times than not, shown a reluctance to invalidate Congressional laws based on the Necessary and Proper clause. During the last couple of decades or so the Court has done so sparingly, but those cases tended to impose a requirement on states and local governments, or violate the principle of federalism, or exceed inferred authority under a claimed provision of the Constitution (e.g. Commerce clause) (Printz v. United States and US v. Lopez). In fact, the 10th amendment is, for all practical purposes, not even mentioned in most relevant majority or dissenting opinions. To do so would open up a pandora's box of petitions that the Court would be reluctant to accept for oral argument.

Also, one's mere existence in the United States requires that you obey federal, state, and local laws and penalizes one for failing to do so.
