John Spirito being underboss has been known for months. It came out in Michael Mancuso's violation hearings a while back.

This all started when Michael Mancuso was seen meeting with the Colombo guys who were under investigation and then he was seen meeting with Genovese guys who were already under investigation. They didn't try hard for this.
