Ifs because it is NOT a Cosa Nostra case per se. It was initially investigated as a fraudulent activity. There are other men (other defendants) who may have broken the law, but are NOT considered mob figures. They were basically legit guys who schemed a fraud. So even though Farese and his friend are mob guys, the feds DO NOT present the indictment that way, not will they prosecute it in open court using the words Mafia, Cosa Nostra, etc.

That would be the fastest way for defense attorney's to cry foul and seek (possibly successfully) a mistrial. At the very least they would be censured, and it would set up any conviction (should there be one) for one helluva appeal.

They don't wanna risk that!
