We don't know that Cici ultimately got a pass. But it's possible to believe he got a pass. He was pointedly asked at the Senate hearing if he ever got a direct order from Michael and he replied, "No, I never talked to him." This may have been a deliberate lie to help Michael--we saw, near the end of GF, that Cici said, "Sal, Tom, the boss says [emphasis added]for you to go on ahead [to the Barzini meeting] and he'll come in his own car..." This could mean that he got a direct order from Michael that resulted in murder (Tessio's). On the other hand, Cici's denial that he ever got a direct order from Michael emboldened Michael to perjure himself--he didn't know Frankie was alive, and therefore thought the Senate committee had no one who could directly implicate him. Michael could have interpreted that as Cici being complicit in the attempt to nail him for perjury. Who knows? My view is that Michael never gave an enemy a pass, and he had adequate reason to regard Cici as an enemy--even if he had no ulterior motive for denying that he got an order from Michael, Cici still broke omerta publicly and said damaging things about "the Corleone Family," as he named it in testimony. Michael might have tried to get to Cici, but he was under very heavy guard. Then, when Frankie appeared out of nowhere, Michael knew who the real enemy was, and who to target. The hearings occurred before the establishment of the Witness Protection Program. My guess is that the Feds put Cici in a protected wing of a federal prison (as they did with Valachi). Michael probably couldn't have gotten to him (at least not easily). But after he brought Vincenzo to Washington to shame Frankie into recanting, and got Tom to convince Frankie to kill himself, Michael probably lost interest in Cici. It just wouldn't have been worth his while to try to whack him in prison.

My point was that the statement could have been construed as a direct order.

this also makes you wonder what happend to the rosota brothers, because the last time we hear of them is that they are on the run. Well one brother died of stomach cancer, the other brother got shot in a restaurant, and the third brother became withdrawn and basically went under after losing the other two. The 3rd brother switched families and still hangs around Red Hook.

In other words, at that point, Cici became small potatoes. Ever notice that Roth is eating a potato chip when he says Frankie is "small potatoes"? LOL... never really connected the two... I was more fixated on Michael's "fixated" death stare at Roth while he nonchalantly says "he is small potatoes" - Michael just knows it... he just feels the rage buiding inside... but he digresses
