I tried to find out what happened with the trial or what connections to organized crime there where to this case if any at all. I was able to see a suspect was indicted and charged in 2016. But there is absolutely no media reports after of a trial or sentencing or why it happened? Anyone know anything else? Just curious.

Acting Brooklyn District Attorney Eric Gonzalez today announced that a 40-year-old man has been indicted for murder and other charges for the shooting death of the owner of L&B Spumoni Gardens Italian Restaurant, who was ambushed outside his home in Dyker Heights, Brooklyn. The victim was carrying $15,000 in cash in a plastic bag when he was killed.

The Acting District Attorney said that, according to the evidence, in the evening on June 30, 2016, the victim, Louis Barbati, 61, left his restaurant, L&B Spumoni Gardens, in Gravesend, carrying a plastic bag containing $15,000 in cash. About 20 minutes later, he arrived at his home, parked his car at the side of the house and got out holding the bag.

The defendant, Andres (“Andy”) Fernandez, 40, of Melville, Long Island, then allegedly walked across the street and shot the victim several times, killing him. The defendant ran, without taking the money, got into a car and fled.

About an hour earlier, the defendant, wearing a dark hooded sweatshirt and sunglasses, had walked to the victim’s home in Dyker Heights and waited, the evidence shows. He also had been present at L&B Restaurant earlier that day, according to the investigation. The defendant was arrested last month by federal authorities.

The Acting District Attorney thanked the Federal Bureau of Investigations and the Office of the United States Attorney for the Eastern District of New York for their assistance in the investigation.

Acting District Attorney Gonzalez said, “We allege that this defendant was lying in wait outside the victim’s home, then ambushed and shot him to death in cold blood. This was a calculated and senseless murder of a beloved business man and I intend to prosecute this crime to the fullest extent of the law.”

Yeah I find it very odd that they've given no motive whatsoever. Just that it was a targeted killing that wasn't a robbery. I've read articles that made a point of saying that since the federal charges were dropped they couldn't find a mob connection. Still seems odd for a random guy to just gun this particular person down for no released reason. I don't see why it couldn't still be an outsourced mob hit.

yeah he waited and knew his time and everything for returning and doesn't touch the $15,000 on him. Unless it was a purely personal beef between the 2 of them, I wish their was more info.

I met a guy at work last night who was from Brooklyn. I told him I was going there next week. He says to get a slice from Spumoni for him. I said the owner was killed last year. He said that was a Fucking mob hit,(then he really got NY on me). He's telling me the details, blah blah blah. I played dumb bc I wish this conversation was never initiated. But they did catch the guy and it was a robbery gone wrong? Right? Unless there was something new that I missed.

The guy that did it was a shit head. it was a robbery and he paniced and fled the scene. Maybe a mob hit would of made it look like a robbery and he actually took the money to make it look good??
This guy is retarded and im quite sure he would have rolled over and dimed out anyone who directed him to do this alleged mob hit by now. It was no hit !!!!!

“It’s a setup,” defense attorney Javier Solano told the jury during opening arguments in Brooklyn Supreme Court. “That’s what this case is, it’s a setup. Andy Fernandez is being used as the fall guy in this case, in this crime.”

This was a weird won. I think i was first on a post typing colombos wants the sauce back. Just a inside robbery. A deliveryman knew boss had cash like that told dude to stick him up. Shit went left or south whatever that saying is and that dudes lucky hes not next to him on the defense table

Like Cali there is more to this, I don't see robbery as a motive it was an execution.

Sean Kelly, a forensic pathologist from the Office of the Chief Medical Examiner, told jurors in Brooklyn Supreme Court that around that time, Barbati was shot from behind by at least five bullets — three of which tore through the left side of his back and punctured his left lung and spleen.

“These wounds in the chest are causing rapid and significant blood loss,” Kelly said.

Barbati was able to make it through a gate leading into his property before collapsing.
