Bronx auto body shop owner who may have been witness in drug case found dead in car trunk

A Bronx auto body shop owner was abducted Tuesday and killed by two masked men — two months after federal court records suggested he was a cooperating witness in a drug case, sources said Wednesday.

Robert Bishun, 36, of Spring Valley, Rockland County, was discovered in the back of his BMW with a zip tie wrapped around his neck, officials said.

The luxury car was left parked on Broadway near the tony Horace Mann School in Fieldston about 11:15 p.m. Tuesday.

About two hours earlier, a pair of men wearing bandannas, stocking caps and gloves stormed into Bishun’s auto body shop, Mobile Creations on Stillwell Ave. in Morris Park, and announced a robbery, cops said.

They bound Bishun’s cousin and his cousin’s girlfriend and forced them into the trunks of cars in the shop before fleeing with Bishun. The pair managed to free themselves and call police, who found the mechanic’s car — and Bishun’s body — 5 miles away.

A source close to the case said the slaying, which was initially believed to be a robbery, may be related to Bishun’s expected testimony as a government witness in an upcoming drug trial in Manhattan Federal Court.

Bishon was arrested following a 2012 raid at his shop, where authorities found 1.5 kilos of cocaine and 250 grams of heroin hidden in a car, officials said. Investigators also seized $40,000 in cash stashed in a Mercedes-Benz registered to Bishun, a .40-caliber handgun, loose ammunition, $30,000 cash from the shop’s office and pay-and-owe sheets detailing millions of dollars in narcotics transactions.

Detectives were tipped off that Bishun had turned his shop into a drug-trafficking hub after a dealer busted in Suffolk County gave up Mobile Creations as his connection, according to a complaint filed in Brooklyn Federal Court.

Bishun, who’d already done a stint in prison, pleaded guilty to the charges in 2014 but hadn’t been sentenced. In July, his name popped up in a court document suggesting he was a cooperating witness. It was posted on Bishun’s criminal case docket by Judge Dennis Hurley on July 22 and titled “Courts standing order regarding procedures to protect cooperation.”

The defense bar and federal prosecutors have expressed concern in recent months about Hurley posting orders referring to cooperation agreements and the potential consequences of the wording.

In response to the pushback, Hurley stayed the order, but it still appears on Bishun’s docket sheet.

“We hope (the document) has nothing to do with it,” the source said.

Bishun’s lawyer, Fred Sosinsky, declined comment.

The auto shop owner’s girlfriend had no idea he may have been cooperating with authorities. “I doubt it very much, but I don’t know. We don’t know,” said the woman, who did not want to be named.

Family members said the father of four was a fixture at the Faith Assembly of God in Spring Valley every Saturday. He even planned to have dinner with the pastor next week to talk about how to get more involved with the church.

“He was a changed man,” Bishun’s uncle David, 55, said. “He was very generous.... He loved his family dearly.”

Federal narcotics agents busted a heroin operation at a Bronx auto shop this month, severing a million dollar supply chain that stretched to Long Island, court records indicate.

They raided Mobile Creations, a luxury car customizing shop, on Feb. 7 after nabbing a Suffolk County drug dealer attempting to sell 68 grams of heroin. The dealer ratted out his supplier, who gave up his source at Mobile, at 1631 Stillwell Ave. near Pelham Parkway in Morris Park, according to a complaint filed in Brooklyn Federal Court.

The drug task force officers had the supplier set up a meet with James Gainer, who allegedly operated out of the Bronx shop, and arrested the suspect with 500 grams of heroin he planned to sell for $28,500, according to the complaint.

They also snatched Mobile Creations manager Robert Bishun after finding 1.5 kilograms of cocaine and 250 grams of heroin hidden in a vehicle at the shop, and $40,000 in cash concealed in a Mercedes-Benz sedan registered to Bishun.

The officers seized a .40 caliber handgun, loose ammunition and $30,000 cash from the shop’s office, along with pay-and-owe sheets detailing millions of dollars in narcotics transactions.

The complaint charges both men with drug dealing and possession and Bishun with possessing a firearm linked to trafficking.

Four drug grinders and a scale were also found in the shop, according to the complaint. The Suffolk County supplier told the agents he met Gainer at Mobile Creations to buy at least 100 grams of heroin a week.

Repair shops and auto parts stores line Stillwell Ave., a quiet street that abuts Metro-North Railroad tracks.

"I just work here 10-6," said Mike James, a mechanic at Mobile Creations, on Monday. "This is a legit shop."

"The shop has been around for over 10 years and they do high-end customization of cars," said Javier Solano, Bishun’s lawyer. "They do Lamborghini-style doors. They do $25,000 rims, $30,000 audio systems."

Bishun and Gainer are being held without bail and have not been indicted yet, said Solano.

Gainer’s lawyer, Lawrence DiGiansante, declined to comment.

An NYPD cop accused of running with a violent drug crew had his bail revoked Wednesday after a cooperating witness set to testify against him was whacked “Don Corleone” gangland-style in the Bronx, the Daily News has learned.

Federal Judge Colleen McMahon made the declaration just hours after victim Robert Bishun, 36, was abducted from his auto body shop and found strangled in the back of his BMW in Fieldston late Tuesday.

“I’ve been around the racetrack once or twice. It certainly sounds like a contract killing,” McMahon said, adding that Bishun’s slaying smacked of “movie violence.”

Details of the grisly murder were outlined in her coutroom by federal prosecutors from the Southern District, who noted the mechanic had been expected to testify against disgraced NYPD Officer Merlin Alston, who’d been out on bail. Alston, 34, is facing narcotic conspiracy charges for being a helper, driver and shotgun-toting bodyguard for Bishun over a four-year period.

During Wednesday’s hearing, federal prosecutor Tom McKay called Bishun a “cooperating witness” who was expected to testify at Alston’s trial in the next two weeks. McKay also claimed his office has recovered text messages that prove Bishun’s role in the trial was being monitored.

After hearing about Bishun’s death — and another cooperating witness in the Alston case who had his house shot up, the officer — whose wife is also a cop — was ordered remanded to custody.

His attorney, Bradley Henry, opposed the remand, claiming the feds had no evidence linking Alston to Bishun’s death.

“There are other witnesses in this case that are going to be much more devastating than Mr. Bishun would ever be,” he said at court. “So to imagine that Mr. Alston orchestrated this whole thing and set up this robbery to keep an individual who is probably a minor or a somewhat minor cooperator against him from testifying at trial just seems outlandish to me.”

Bishun may have been slated to testify against Alston because in 2010, the crooked cop and the dealer twice picked up cocaine from a hidden compartment in a car at the dead man’s auto body shop, records show.

Bishun was discovered badly beaten and unconscious in the back of his BMW with a zip tie wrapped around his neck, officials said. The luxury car was left parked on Broadway near the tony Horace Mann School in Fieldston about 11:15 p.m. Tuesday.

The mechanic’s longtime girlfriend told detectives that he recently met with a federal prosecutor to discuss a heroin trafficking arrest dating back to 2012, according to sources.

Bishun was arrested in 2012 after a raid at his shop, where authorities found cocaine and heroin hidden in a car, officials said.

Investigators also seized $40,000 in cash stashed in a Mercedes-Benz registered to Bishun, a .40-caliber handgun, loose ammunition, $30,000 cash from the shop’s office and pay-and-owe sheets detailing millions of dollars in narcotics transactions.

Detectives learned Bishun’s shop was being used as a drug-trafficking hub from a dealer busted in Suffolk County, according to a complaint filed in Brooklyn Federal Court.

In November 2014, Bishun pleaded guilty to conspiracy to traffic drugs and agreed to be on supervised bail for five years.

He was never formally sentenced to prison.

Alston was indicted a month later in December 2014 for conspiracy and official misconduct for driving the drug trafficker around and arranging cocaine transactions between 2010 and 2014.

On at least one occasion, Alston went to a drug meet armed with a shotgun, the records show.

Assistant Manhattan U.S. Attorney Thomas McKay confirmed Bishun's online court docket in the Eastern District of New York drug case was being monitored.

The Daily News reported Wednesday that Long Island Federal Judge Denis Hurley had posted an entry on the dockets of all his criminal defendants — including Bishun — involving "procedures to protect cooperation information." Members of the defense bar and the Brooklyn U.S. Attorney's office had expressed concern to the judge about the order.

"Text messages with screenshots of that part of the docket made their way back to Mr. Bishun through friends and family members," McKay said in court the day after Bishun's brutal killing, according to a transcript. "There's a tab for an open email that says, 'Rob, cooperation request.'"

Alston remains suspended from the force pending the outcome of his criminal case, the NYPD said.

Has anyone considered how odd this hit is;

So they hold up the site. Then kidnap the target and 2 randoms. Then the 2 randoms ‘escape.’ Then instead of shooting him they beat him and strangle him locally in a hot area in a hot car within a close vicinity of where they took him from.

Maybe they done it this way to make it seem like it wasn’t what it was. Just seems messy. Why didn’t they just drop him in the shop.
