An Orlando man was charged with possession of crystal meth with a gun, but a state crime lab proved him right — it was actually glaze from Krispy Kreme doughnuts.

When the man stopped by the 7-Eleven without buying anything and left with an employee in his car, cops were suspicious.

Orlando police were staking out the convenience store, 938 W. Colonial Dr., after neighbors complained of drug activity, the Orlando Sentinel reported. Police saw the man in the silver Chevy leave without stopping at the stop sign and speed off going 42 miles per hour in a 30 mph zone, according to the report. They pulled him over.

The officer saw his concealed weapon license, asked to hold onto his gun for safety and had the driver get out of the car. That’s when the veteran officer saw four flakes of a white substance on the floor.

"I recognized through my 11 years of training and experience as a law enforcement officer the substance to be some sort of narcotic," the officer wrote in her report.




The driver let her search the car, and she found more chunks, which two roadside tests showed were crystal methamphetamine.

Daniel Rushing was arrested, charged with possession with a weapon, strip-searched and jailed in December.

The 64-year-old Orlando man told officers he’d never done drugs in his life, and the crumbs were from his Krispy Kreme doughnut.

Weeks later, a state crime lab proved him right.

“I kept telling them, 'That's … glaze from a doughnut. … They tried to say it was crack cocaine at first, then they said, 'No, it's meth, crystal meth," Rushing told the Sentinel.

The 7-Eleven stop was a favor for a church friend, an elderly woman who worked at the service station, he told the paper. Rushing used to treat himself to a Krispy Kreme doughnut every other Wednesday and enjoyed the snack in his car.

The state attorney’s office dropped the case, the Sentinel reported, but Rushing hired a lawyer. He plans to ask the city for damages.

“It feels scary when you haven't done anything wrong and get arrested,” he told the paper. “It's just a terrible feeling

Gotta wonder what's in those donuts to score a positive for crystal meth on a test. Either that or those cops bought some fairly worthless test kits

When his lawyers sue, those "roadside test"evidence kits will disappear.

I have a hard time accepting a cop with that many years under his belt , can't tell the difference between a Cop related item and job related item. 😁

sad that we joke about it. Innocent people's lives ruined everyday all across America by the biggest gang in the country. These kind of people are human scum. Sociopaths with badges.

I hate to say it, but there's some truth to that. Too many innocent people are being hurt by this "War On Drugs". Maybe calling it a war was a mistake, because people are conditioned to accept that civilians get hurt in war...

Body camera video of the incident, available above, shows Cashe telling the officer that he didn't realize the lights weren't on and apologizing for the misunderstanding.

The officer then runs Cashe's information and realizes he's on probation and has a curfew. The officer's laptop lists Cashe's curfew as 8 p.m. Cashe repeatedly tells the officer that information is incorrect, his curfew is actually 10 p.m. and he has a document in his wallet that proves it.

"I've got a drug offender's probation for 10 o'clock," Cashe tells the officer.

The arrest report notes that the information the officer retrieved on his laptop was incorrect due to a clerical error, and Cashe's curfew was 10 p.m., not 8 p.m.

A drug-sniffing K-9 was brought to the scene and alerted on Cashe's vehicle, giving the officers probable cause to perform a search.

A small piece of suspected marijuana and a white substance that appeared to be crack-cocaine were found in the car, police said.

"It looks like he had a gram and he crushed it up when he saw you," one officer says to another in the video.

The substance, which Cashe told the court was drywall, tested positive for cocaine during a field test and Cashe was arrested on drug charges.

Oviedo police told News 6 that prosecutors decided to only send the suspected cocaine for Florida Department of Law Enforcement lab testing. When the results came back on May 16, they showed that substance was negative for any kind of drugs.

It took another month until Cashe was released from jail on June 19. He told News 6 he blames racial profiling for the incident and that he's looking into a way to be compensated for the three months of work he missed while he was being held in jail.

"I was profiled. It wasn't the first time, it just was just the worst of those times," Cashe said.

The Oviedo Police Department said it plans to reevaluate its field testing procedures. She said the tests they currently use are 99 percent accurate.



For the record, the town that this drywall incident happened is just outside of Orlando where the Krispy Kreme/meth incident happened. The might be in the same county and share lab facilities.


Oh, and when I found the article to THIS story, there was a related story about the "Krispy Kreme" cop getting a strong reprimand letter for what she did to the innocent krispy kreme guy.
You get locked up and cop gets reprimand letter, sounds fair. lol
