It got squashed because Carmine wasn't entirely in the right there. Imagine if it was your daughter .

Balsamo was a cop. He retired in 1992 on disability. The shooting was in 2005. He likely wasn't such an innocent either, seeing that he had two Bonanno associates who were his friends.
