Notorious gangster charged with using mob goons to collect money from 70-year-old deadbeat

KEN MURRAY/NEW YORK DAILY NEWS
Michael Capra is a Luchese associate who was used to assault the 70-year-old deadbeat, according to court papers.

A Luchese oldfella was charged Tuesday with dispatching a couple of mob goons to collect money from a 70-year-old deadbeat.

Reputed capo Carmine Avellino, 70, didn’t cut the fellow septuagenarian any slack on a $100,000 loan he was late repaying, officials said.

Avellino is charged with sending Luchese associates and brothers, Michael and Daniel Capra, to assault the victim in 2010, according to court papers. The Capras were arrested last year and are awaiting trial on the same charges.

Defense lawyer Scott Leemon entered a not guilty plea to the indictment on behalf of his client who was ordered held pending a bail hearing next week.

“These allegations go back over four years so the question is, why did it take them so long to bring these charges?” Leemon said.

In the mid-1990s, Avellino was charged with the murders of Long Island garbage carters Robert Kubecka and Donald Barstow as part of a mob extortion scheme. Avellino pleaded guilty to racketeering and was sentenced to 10 years in prison.

His brother Salvatore Avellino, a reputed Luchese soldier, appeared at the arraignment in Brooklyn Federal Court and chatted with FBI agents.

Lucchese captain out on $1 million dollar bail

Father's Day came early for reputed Lucchese capo Carmine Avellino.

Avellino, 70, was sprung on $1 million bail Monday into the arms of his exuberant daughter outside Brooklyn Federal Court. “Daddy!” his unidentified daughter cried when Avellino stepped outside, accompanied by a U.S. marshal, to retrieve a shopping bag containing a change of clothes.

Federal prosecutors initially argued that the mobster, indicted last week for extortion, should be kept jailed because he is a danger to the community. But Assistant U.S. Attorney Celia Cohen consented to his release after another of Avellino’s daughter posted her $1 million home as bail.

Avellino will be on a strict 7 p.m.-to-8 a.m. curfew with electronic monitoring.

Avellino is charged with ordering a pair of Lucchese goons to work over an elderly deadbeat who was late paying back a $100,000 loan.

Re: Luchese capo indicted - 05/20/14 01:27 PM

Interesting he looks pretty good doesn't he for an old guy. In his head he thinks like 20 year old I am guessing.

Who gets 100 thousand loan from these guys? Maybe somebody that he has known and borrowed money from for 50 years. Like a big time gambler who owns a good business who he knows will pay it back in a weeK or less. Since the borrower is old he would not want to carry that kind of money on him. So they go to his house and pick it up with int.

Or he knows him and he loans him money to get some kind of favor from him. Then the borrower does not do him the favor he needs from him. They get that favor because they know the guy can not pay it back in a timely fashion. That favor was probably worth millions them if he did it.

What did the guy they loaned the money to do?

Re: Luchese capo indicted - 05/20/14 01:44 PM

Interesting... I didn't know Sal was still kicking either. Amazing this guy is not in prison... Gave the Barstow/Kubecka order, plus whoever else, survived Amuso/Casso. Define active. Carmine was active. I think if these guys still in NYC and outlying areas they are still active. Punchy was active in his last days. I think if they wanted to retire they'd leave ground zero for the Mafia. Too many chances for a beef, a hit for some past deed long forgotten, etc.

Yeah, that's him. But Jimmy Brown got along fine with Avellino, so it was a little bit out of character for him. But it just goes to show that even the best of these guys like to hear themselves talk sometimes. Because Sal Avellino always had a reputation for being a straight shooter and a gentleman smile .
