Lucchese guy. Nicky Barnes' original heroin supplier. It says he's not in federal custody anymore so is he active?

He is currently under indictment and has not gone trial yet and is on out on bail he got busted in the big Lucchese gambling case in 08 or 09 I can't remember the exact year so at the moment it's hard to tell if is active or not but he was active and served on a 3 capo ruling panel up to that bust

Everyone in the case was originally arrested in 2007 but the indictment came down in 2010. Madonna was also caught up in the 2009 case that involved kickbacks to New York Department of Buildings inspectors.
