Thomas Gioeli Gets 18 Years - 03/20/14 04:55 PM

Thomas “Tommy Shots” Gioeli the former acting boss of the Colombo crime family was sentenced to 18 years in prison for multiple murder and racketeering conspiracy raps. Back in 2012 Gioeli was convicted of plotting gangland hits against rivals John Minerva and Frank Marasa along with a single charge of orchestrating violence against rivals to gain power. But the New York mafia leader was some how acquitted on several murder charges and avoided a probable life sentence. Although his lawyers argued before sentencing asking for leniency saying at the age of 61 a long term sentence would be equal to a life sentence.

18 years is definitely a lenient sentence for a boss found guilty of multiple murders and racketeering to top it all off.

Fed time is closer to 90 percent than 80 percent and he'll max out because, whether it's right or whether it's wrong, they view him as a cop killer. So no matter how you spin it, he has about a ten spot to go. His lawyer wasn't lying when he said that Gioeli is an "old" 62. He has a bad heart and type 1 diabetes, which is the worst kind. I doubt he comes home alive.

But then again, some of these tough old bastards live to spite the government. They had Greg DePalma dead from cancer and a bum ticker when he was still in his 60's, and he didn't cash in until he was close to 80. And Gotti was fond of saying that he'd "outlive them all." But I'm not sure if those guys are the best examples. Because they both died handcuffed to a hospital gurney wink.

this is another weird thing when it comes to the federal judges believing the rats, yesterday the fbi puts out a press release don't know how to post it some1 can. the judge believes he was respocible for the wild bill murder and soe other poor nobody but was found not guilty of but he doesn't say a peep about who killed the nycpd guy. like they and the judge forgot to put that it the press release. yaeh we know we put 2 guys on the stand that killed a cop and will let him walk in a couple months. they better deport that guy dino he wasn't born here shit hit him with the 2million dollar fine like they hit that guy Anthony arillotta. how that hell is that guy Anthony gonna pay 2 mill from witsec you know why the gov went ahead with a 2million dollar fine they don't want al Bruno sons to ever get a dollar on there wrongfull death lawsuit against Anthony that's just fucked up. government plays chess well everyone else plays checkers. hope I spelled that rite. plus it didn't look good for the son of a mob capo showing up at like 5 different sentencing of mob rats and asking for the judge to give them life and at Emilio fusco senticing saying I forgive you.

While this sentence was within the guidelines, there is going to supreme court case about sentencing in the context of being acquitted of the vast majority of charges but the judge still considering the acquitted charges in sentencing.

Quote:

The D.C. Circuit case is U.S. v. Jones, No. 08-3033 (DC Cir. Mar. 14, 2014) (available here). In a nutshell, defendant Antwuan Ball was indicted for a massive drug conspiracy and associated murders. Ball put the government to its burden of proof concerning the allegations. Following a very lengthy jury trial, Ball was acquitted on all the counts, except for one crack distribution count. At sentencing, District Judge Richard Roberts found “clear evidence of [Ball's leadership in] a drug conspiracy” and sentenced Ball to a 225-month prison sentence for the drug distribution — far in excess of the recommended guideline sentence for the drug distribution charge alone.

my main point was why did the judge belive the rats on some murders but didn't think gioeli was responsible for the cops mmurder. just cant wrap it around my head. and does anyone ever remember a mob rat getting a 2million dolaar fine except massino who had some real sneaky deal. keep 5 million in nyc real estate but were taking your attic of gold bars and cash. shit where was the home invasion guys on that one.

In my mind, it gives the feds two bites of the apple. They can lose their case in front of the jury (the legitimate fact finder) but then appeal to the judge during sentencing to find "by a preponderance of evidence" that the defendant is actually guilty of the acquitted conduct. You end up with these strange results that way.

In this case Im not sure whether the judge clearly aggravated the punishment by things specifically rejected by the jury

This looks like a pretty harsh sentence. The real kicker is the murder conspiracy he was convicted of is the one he most likely had nothing to do with.

How much time did Dino Saracino get? Has he been sentenced yet?

Thanks Dellacroce. You think he will get more time than Gioeli, seeing as how he was most likely one of the shooters in several of the hits?

Re: Thomas Gioeli Gets 18 Years - 03/20/14 11:50 PM

O yeah the judge is gonna throw the book at him, i believe he is looking at 20 years for racketering, and the feds are asking for 80 years for his obstruction of justices charges, but that seems kinda high.

Re: Thomas Gioeli Gets 18 Years - 03/20/14 11:57 PM

I say he gets 20 years but then again we all know he is a murderer so the judge should give him life. I think the judge in this case wants to make sure Gioeli and Saracino either die in prison or get so much time that they are in adult diapers when they get out.

I suspect Gioeli might be wearing them already lol. I got to give it to Kenji he had the best nickname for Tommy shots. Tommy bitch tits lol.
